Terms and conditions of sale

The following Terms and Conditions of sale are an integral element of all our materials supply contracts even when orders are made by telephone, verbally, by fax, e-mail, or using the internet.
ALTEAWEB may find it necessary to update and modify parts of its Terms and Conditions of Sale, for this reason we invite customers to consult our terms and conditions each time they visit our site www.alteaweb.it.

Acceptance of Terms and Conditions of sale
1. The contract stipulated between ALTEAWEB and the customer must be considered as complete on the acceptance, even if only partial, of the order by ALTEAWEB. This acceptance is considered as implicit if not otherwise communicated in any way to the Customer.
By submitting an order in any of the various ways available you declare full agreement with the terms and conditions of sale and payment set out as follows.

2. If the Customer is a consumer (an actual person buying goods for themselves and not for professional ends, and who makes their purchase without indicating a VAT number) when the online purchasing procedure has been completed they must print or save an electronic copy or in some other manner keep a copy of these Terms and Conditions of sale as pursuant to art. 3 and 4 of Legislative Decree 22 May 1999 No. 185 regulating distance selling.

3. Any right of the Client to compensable damages or indemnification is excluded, including any and all liability expressed or implied in contract for direct or indirect damages to persons and/or things, caused by the lack of acceptance, including partial acceptance, of an order.

Orders
4. The Customer can purchase products as described in their relative technical files. It is considered as implicit that the images accompanying the technical details of a product may not be perfectly representative of the product characteristics: it may differ from the colour, size, and the accessories in the image. All the support information for purchasing must be considered as simple generic informative material, not necessarily an exact representation of the characteristics of a single product. In the product catalogue published on the website www.alteaweb.it , ALTEAWEB cannot guarantee the certainty of the availability of the goods ordered as online orders to not modify the availability information about a product in real-time. However, we undertake to inform the Customer as soon as possible in the unlikely event that the product ordered has become unavailable.

5. Correct receipt of an order is confirmed by ALTEAWEB by e-mail sent to the Customer to the e-mail address provided by the Customer. Our confirmation e-mail includes the time and date of the order being made and a "Customer Order Number", which must be quoted in all subsequent correspondence with ALTEAWEB. The message contains all the information provided by the Customer who undertakes to verify its exactness and to immediately inform ALTEAWEB of any corrections, following the methods described in the Terms and Conditions of sale.

6. In the case of the order not being accepted ALTEAWEB will inform the Customer of this as soon as possible.

7. Any requests for estimates do not in any case represent an "executive order of sale".

Prices
8. The prices displayed on the website www.alteaweb.it do not include VAT and may change from day to day without prior notice. These variations are strictly connected to the market situation or fluctuations in exchange rates.
The prices on the invoice will be those current at the time of delivery.

Payment methods
9. In the case of payment by Bank Transfer, the items ordered by the Customer will be held until we receive proof of the Bank Transfer being made, which must be sent to ALTEAWEB (by fax or e-mail) within and not after 3 working days from the date of acceptance of the order. The reason clause on the Bank Transfer must include: the order reference number; the date when the order was made; the name and surname of the entity ordering.

10. If the Customer chooses the Pay on Delivery option purchases may not exceed € 430.00. The Customer will not be required to pay the carrier any more than the sum indicated at the time of ordering.

11. In the case of payment by credit card or paypal, our Banking Institute handling such transactions will authorise the transferral of the sum relative to the purchase. In the case of the cancellation of an order, ALTEAWEB will request cancellation of the transaction and reimburse the sum in question.
Once the transaction has been cancelled, ALTEAWEB cannot in any way be held responsible for delays and/or damages caused by the Banking system.

Security
12. ALTEAWEB does not at any stage of the credit card sales procedures have the ability to find out the personal information of the card holder. Credit card information is sent directly to the Banking institute that handles such transactions using a Secure Server adopting the SSL (Secure Socket Layer) protection system.
The information relative to the credit card will be sent over an SSL encryption protected connection in order to make it impossible for external users to intercept this data. The SSL encryption system guarantees that nobody can in any way read the information sent over the internet.
AT NO TIME OR IN ANY WAY DOES ALTEAWEB RECEIVE THE credit card number.
Contrary to credit card purchases in traditional transactions (ie. in shops) where the card details pass under the eyes of the owner, sales staff, or waiter, an online transaction is absolutely secure as nobody, not even ALTEAWEB, can access the codes of the Credit Card used.
If payment is accepted, confirmation is immediate and we simply receive an e-mail from our Bank confirming the transaction. No traces of the Credit Card codes are left in our files. This procedure is completely secure and completely guarantees purchaser and seller security.

Invoicing
13. For each order ALTEAWEB issues an invoice for the goods shipped. The invoice is compiled using the information supplied by the Customer at the time of ordering. The sums on the invoice are only expressed in Euro. The invoice will be sent as a pdf file to the e-mail address supplied by the Customer when the order was submitted. In the case that the Customer wants a hard copy of the invoice, simply contact us requesting a copy which we will send by traditional post.

Delivery methods and costs
14. Delivery costs are calculated based on weight. Delivery costs will be calculated and displayed in the shopping cart at the moment of compiling the order.
Delivery costs are billed to the Customer, as is explicitly highlighted when the order is made. Payment for goods by the Customer will be made using the method chosen when the order was submitted.

15. Delivery times vary depending on the method of payment and destination. If Credit Card payment is chosen the goods will be despatched immediately; if payment by Bank Transfer is chosen the goods ordered will only be despatched upon accreditation of the sum owed to ALTEAWEB’s current account.
Italy: 24-48 hours
European Union: 2-3 days
ALTEAWEB cannot be held responsible for delays to the despatch of an order or delivery of goods ordered.

16. On delivery of goods by the carrier, the Customer must check that the packaging is intact, not damaged or damp or in any way adulterated, including sealing materials (adhesive tape or metal straps). Any damages or discrepancies in the number of parcels or regarding the indications must be immediately brought to the notice of the carrier present and contested. Once the Customer has signed the carrier's delivery document they will no longer be able to contest the exterior characteristics of the consignment.

17. Upon receipt of delivery, in the case of evident damage, it is possible to accept the delivery with "reserve".
Method: before signing the consignment note for acceptance, write your reserve specifying your motives and where possible inform us of the details of the damage as soon as possible.

18. Any problems with the physical integrity of the delivery, its correspondence with the order or the completeness of the products received, must be immediately be reported to ALTEAWEB by e-mail to altea@alteaweb.it and subsequently confirmed by registered post or telegram to ALTEA S.r.l. - Via Vincenzo Monti, 8 - 20123 - Milan (MI) within 3 working days from the date of consignment.

19. If after 5 working days the goods are left unclaimed in the carrier's possession due to repeated inability to deliver the goods to the address provided by the Customer when

Returns and cancellation policy
20. Pursuant to art. 64 of Legislative Decree 6 September 2005, No. 206, if the Customer is a consumer (an actual person buying goods for themselves and not for professional ends, who makes their purchase without indicating a VAT number) they have the right to cancel the purchase contract for any reason, without being required to provide explanations or pay any penalty, except in the cases indicated in the next point.

21. To exercise this right the Customer must notify ALTEAWEB of these intentions within 14 working days of the date of receiving the goods. In this notification the Customer must describe their wish to cancel the purchase and provide their e-mail address.
This notification must be sent by registered post with return receipt to ALTEA S.r.l. - Via Vincenzo Monti, 8 - 20123 - Milan (MI), Italy, or else by telegram or fax sent within the same time period of 14 days and followed by registered post with return receipt that MUST be sent within the following 48 hours.
Advance notification of this communication must be made by e-mail to altea@alteaweb.it with "Cancellation of purchase" in the subject line. Once we have received this notification of purchase cancellation the Customer Services department will send the Customer a Return Merchandise Authorisation code (RMA) which will allow the parcel to be accepted by our stores.
Goods may not be returned without prior authorisation from ALTEAWEB.

22. The Customer's right to return goods is subject to the following conditions:

  • 22a) the right is applied to the item purchased as a whole; it is not possible to return only part of the product purchased (ie: accessories, connected software, etc...);
  • 22b) the right is not applied to audio-visual products or sealed software (including that attached to hardware items) once such products have been opened:
  • 22c) the item purchased must be integral and returned in the original packaging complete in all its parts (including packaging and any documentation and supplied accessories: manuals, cables, etc...); to limit damages to the original packaging, we recommend that where possible the Customer places it in a second box with the RMA (Retuned Merchandise Authorisation code) clearly marked; the Customer must avoid attaching labels or adhesive tape directly on the product's original packaging;
  • 22d) in accordance with the law the shipping charges for returning goods must be paid by the Customer;
  • 22e) during shipping, until attestation of the goods' arrival in our stores, returned goods are the responsibility of the Customer;
  • 22f) in the case of damages to the goods occurring during shipping, ALTEAWEB will inform the Customer of this fact (by the 5th day from the date of receipt of the returned goods in our stores) in order that they may immediately take up the matter with the carrier they chose and obtain reimbursement of the value of the item (if insured); in this case the product will be made available to be returned to the Customer at the same time as cancelling the request to cancel your purchase;
  • 22g) ALTEAWEB accepts no responsibility for damages or theft/loss of returned goods travelling by uninsured delivery; ALTEAWEB reserves the right to hold back any damages suffered by withholding payment of part of the sum to be refunded.

23. ALTEAWEB will refund the Customer the whole amount already paid, with the deduction of any sums necessary for damages as mentioned in the previous point, by Bank Transfer within 14 days from the receipt of returned goods.
The Customer is responsible for providing their bank details for the refund (IBAN of the invoice holder).

24. The right to cancel your purchase becomes void if the essential condition of the integrity of the item (packaging and/or content) is not met, in cases where ALTEAWEB ascertains:

  • 24a) the absence of the original external packaging and/or internal packaging;
  • 24b) the absence of elements supplied with the product (accessories, cables etc.);
  • 24c) the product has been damaged by causes not linked to shipping. Where the right to cancel purchase becomes void, ALTEAWEB will return the goods to the sender and charge them the shipping costs.

Warranties
25. All the products sold by ALTEAWEB are covered by the official guarantee of the manufacturers: minimum validity 24 months for the consumer (an actual person buying goods for themselves and not for professional ends, who makes their purchase without indicating a VAT number); 12 months for purchases made by companies or for professional reasons.
To use the warranty the Customer must keep the purchase invoice.

26. The warranty is valid for products with faults and/or malfunctions that were not apparent at the time of purchase, as long as the product has been used correctly and for the correct purposes with due respect as per any technical documentation.

27. Repair services during the warranty period are guaranteed by the Assistance Centres authorised by the individual manufacturers. Shipping costs for sending and receiving goods for repair are paid by the customer unless otherwise specified in the warranty policies of the manufacturers in question.

28. If, following the intervention of an authorised Assistance Centre the problem proves to be a fault NOT covered by the warranty agreement, the Customer will be billed costs for any testing, verification and repair that may be undertaken by the authorised Assistance centre.

29. Exchanges in the case of DOA (Dead On Arrival: product not working at time of delivery) are effectuated only if expressly provided for by the specifications of the manufacturers. The time period required for exchanges or any repairs depends exclusively on the policies of the manufacturers.

30. In the case where for whatever reason ALTEAWEB is not able to return to the client a product covered by warranty (restored or substituted), it may at its own discretion proceed to refund the whole sum paid or replace the product with one with similar or superior characteristics.

31. No damages may be claimed from ALTEAWEB for any delays in the execution of repairs or replacements.

32. In all cases, the product to be repaired or replaced must be returned by the Customer to us in its original packaging and complete in all it parts (including packaging and any documentation and accessories supplied with it: manuals, cables, etc...);
In order to limit damages to the original packaging, we recommend that where possible the Customer places it in a second box with the RMA (Retuned Merchandise Authorisation code) clearly marked;
In all cases the Customer must avoid attaching labels or adhesive tape directly on the product's original packaging;

Privacy
33. Personal data is collected and processed in order to satisfy the express requests of the Customer and will not in any case or for any reason be given to Third parties. ALTEAWEB guarantees its customers compliance with the regulations concerning the protection and processing of personal data as per Legislative Decree 30 June 2003 No. 196 and the protection of persons and other subjects as regards the processing of personal data as per Law No. 675 of 31/12/1996.

Claims
34. All claims must be addressed to ALTEA S.r.l., registered office Via Vincenzo Monti, 8 - 20123 – Milan, Italy.

Applicable laws and Place of jurisdiction
35. The present Terms and Conditions of sale and the relations between ALTEAWEB and the consumer are regulated by Italian Law and in particular Legislative Decree 70/2003 regarding electronic sales and Legislative Decree 206/2005 with specific reference to the laws regarding distance sales contracts.
For civil disputes inherent to the application of the present contract, the authority of the Court with jurisdiction over the Customer's place of residence or domicile will be deferred to if within Italian territory.
For any other dispute both parties must accept the exclusive authority of the Court with jurisdiction over the registered office of ALTEA S.r.l.
